备注说明:
(1)运费(Freight):是船方提供运输服务的报酬。可采用运费率,即按货物单位重量或体积若
干金额计费;也可按整船定一个总值(Lumpsum Freight)即所谓 "包干运费"。
(2)装卸费用:租船合同对于装卸费负担的划分有以下四种:
①船方负责装卸费(Gross/Berth Terms),又可称为班轮条件(Liner Terms),费用划分一般
以船边为界。
②船方不负担装卸费(FIO,Free In and Out)。
③船方管装不管卸(FO)。
④船方管卸不管装(FI)。
(3)BSS 1/1:即BASIS 1/1,是指基于一个装货港和一个卸货港

卸货率: 每晴天工作日12,000,包括星期天及节假日。
8. DEMURRAGE/NO DESPATCH: CHTRS TO PAY SHIPOWNER USD20,000.00 PER DAY
OR PRO-RATA FOR LAYTIME LOST AT L/D PORT,NO DESPATCH. DEM AT LOADING
PORT WILL BE SETTLED WITHIN OCEAN FRT,DEM AT DISCHG PORT WILL BE
SETTLED W/I 3 DAYS AGAINST RELATIVE DOX AFTER COMPLETING
DISCHARGING ,BUT ALWAYS BEFORE RELEASE ALL OF THE CGO.

滞期费/无速遣费:如在装卸港产生的时间损失租家应按每天20000美金支付给船东,不足一天
按比例计算。无速遣费。如在装港产生的滞期费和运费一起结算,如在卸港产生的滞期费则租
船人在卸货完毕后3个银行工作日内凭相关文件支付给船东,但无论如何须在放货前结算清楚。
DETENTION:
– CHARTERER GUARANTEE THAT CARGO AND THE DOCUMENTS MUST BE READY
FOR LOADING BEFORE VESSEL’S ARRIVAL AND COMMENCE LOADING 72 HOURS
WITHIN VESSEL ARRIVAL LOADING NOT COMMENCE LOADING WITHIN 72
HOURS OF VESSEL ARRIVAL DUE TO CARGO/DOC NOT READY,CHARTERER
SHOULD PAY DETENTION USD20,000 /DAY EVERY 3 DAYS IN ADVANCE .OTHERWISE
OWNER HAS RIGHT TO WITHDRAW THE VESSEL WITH NOTICE BY TELEX OR FAX
WITH THE DEPOSIT LAYDAY RUN OUT VESSEL ENTERS
DEMURRAGE,CHARTERERS TO PAY OWNERS DEMURRAGE EVERY 3 DAYS OR
PRO-RATA,FAILING WHICH,OWNER HAS RIGHT TO WITHDRAW THE VESSEL WITH
DEPOSIT EARNED.
在船舶到港前,租家应保证货物和资料已经备妥,并在船舶抵达后的72小时内装货。如果在船
舶到达的72个小时以內沒有裝货或由于货物/单证没有备妥,租家應每3天预付20,000美元/
天的延滯费,否则船东有权以电传或者传真形式撤船并沒收保证金。如果LAYTIME时间用完,
船舶进入滯期,租家应每3天预付滯期费或按比例计算,如果沒有做到,船东有权撤船并沒收
定金。
9. FRT PAYMENT: 运费支付
9.1 20% FREIGHT AS DEPOSIT TO BE PAID BY CHRTRS TO ONR’S NOMI ACCT W/I 3
DAYS AFTER SIGNING THIS F/N BY BOTH E 80% TO BE PAIED BY
THE CHARTERER INTO OWNERS NOMINATED ACCT WITHIN 3 DAYS AFTER
COMPLETION OF LOADING BUT ALWAYS BBB. ORI BS/L TO BE SIGNED/RELEASED
AFTER ONR HV CHRTR’S FULL PAYMENT IN ONR’S NOMI ACCT.
合同签定后3个银行工作日内租家将20%运费做为保证金付到船东指定帐户。剩余80%运费
在装货完毕后3个银行工作日内支付到船东指定帐户。船东在收到租船人全额海运费后签发正
本提单给租船人,提单应注明“运费已付”。
9.2 ALL FREIGHT SHALL BE DEEMED EARNED AS CARGO IS LOADED ON BOARD,
AND FREIGHT IS DISCOUNTLESS NON-RETURNABLE WHETHER THE VESSEL OR
THE CARGO IS LOST OR NOT.
货物装船后全部运费均不能折扣不能返还,无论船舶/货物灭失与否。
10. LAYTIME
10.1 LAYTIME SHALL COMMENCE TO COUNT AT 13:00PM, IF NOR TENDERED
BEFORE 12:00 AND AT 08:00AM ON NEXT DAY IF NOR TENDERED IN
AFTERNOON ,UNLESS LOADNG/DISCHARGING SOONER COMMENCED IN WHICH
CASE THE ACTUAL TIME COUNT AS LAYTIME. TIME FOR WAITING BERTH IS
COUNT AS LAYTIME。NOR TO BE TENDERED AT ANY TIME UPON VSL’S ARRVL AT
PILOT STATION AT LOAD/DICHG PORT W.W.W.W.
装/卸货时间起算时间点:如果船舶到锚地准备就绪通知书在1200时之前递交,装卸时间从1300
时起算;如果通知书在1200时之后的递交, 装卸时间从下一个日历日的0800时起算。如装卸提
前开始,则实际使用时间计入装卸时间。等泊时间算入装卸时间。装卸准备就绪通知书应在船
舶到达装卸港的引航锚地后的任何时间递交,无论在港与否,无论在泊位与否,无论通过联检与否,

无论通关与否.
10.2. REASONABLE TIME FOR DRAFT SURVEY AND VSL PILOT AND JOINT
INSPECTION AND QURANTINE NOT COUNT AS LAYTIME. HOWEVER,
CHTRS/SHPPRS/RCVRS SHUD NOT DELAY THE VSL ON PURPOSE.
合理的看水尺、引水、检验和检疫的时间不算入装卸时间。但租家/发货人/收货人不得故意拖
延时间.
10.3. SHIFTG TIME FROM ANCHG TO BERTH AND FROM BERTH TO ANCHG NOT
ACCT AS LAYTIME.
IF THE ADDITIONALL SHIFTING REQUESTED BY CHTRS/SHPR/CONSIGNEE,THE
TIME AND CHARGE TOBE FOR CHTRS ACCT。
从锚地移到泊位和从泊位移到锚地的时间不算装卸时间。如果船舶的额外移泊是由租家/发货人
/收货人要求的,则该移泊的时间和费用由租家承担。
10.4. TIME FOR FIRST OPENING N FINAL CLOSING HATCHES BENDS NOT COUNT AS
LAYTIME
装卸两港第一次开舱和最后一次关舱的时间不计入不算装卸时间.
10.5 BEFORE LOADING OWNERS UNDERTAKE TO HAVE SHIP'S HOLDS CLEANED,
DRY AND FREE FROM LOOSE RUST AND IN EVERY RESPECT READY AND SUITABLE
TO LOAD COAL IN BULK, VESSEL TO PASS HOLD/HATCH SURVEY, TIME NOT TO
COUNT AS LAYTIME FROM FAILING SUCH SURVEY UNTIL VESSEL HAS PASSED
SURVEY.
10.5 在装货之前,船东负责保持货舱的清洁、干燥且无生锈的,并准备好各方面的,且适合装
载散装煤炭,负责船只通过货舱/舱口的检测,从开始验舱直到验舱通过的这段时间不计入装载
时间,
11. LIGHTENING/LIGHTAGE IF ANY TBF CHTRS ACCT AT BENDS。
在装卸港如果发生过驳/减载,费用由租家负责。
12. OWNER/MASTER TO ADVISE 5/3/2/1 DAYS BEFORE ARRVL AT LOADG/DISCHG
PORT.
船到达装港/卸港前,船东/船长需提前5/3/2/1天向装卸港代理或租家通报船舶预抵动态。
13. THE LOADING /DISCHG WILL USE VSL GEARS. FLOATING CRANE IF ANY TBF
CHRTR’S ARRANGEMENT & ACCT.
装卸货港使用船吊,如需租用浮吊或岸吊由租船人安排并支付费用。
AGENT AT LOAD PORT & CHARTERER’S AGENT AT DISCHARGE PORT.
14.船东指定装港的船舶代理,租船人指定卸港的船舶代理。
15. ANY TAXES/DUES/WHARF AGES ON VSL/FRT TBF OWN ACCT,SAME ON CGO TBF
CHTRS ACCT BENDS
装卸两港有关于货物的税/费由租家负责,同样所有关于船舶/运费的税/费由船东负责。

16. SHIPOWNER’S OR CONGEN BILLS OF LADING TO BE ORIGINAL BILL OF
LOADG NOT AVAILABLE AT DISCHG PORT, MASTER/OWNER/AGENT ALLOW CGO
TO BE RELEASED AGAINST RVCR’S BANK LETTER OF INDEMNITY IN OWNRS
STANDARD P&I CLUB WORDING.
使用船东的或金康格式的提单。若正本提单在船舶到达卸港前无法按时到达卸港,船东/船长/
代理/将凭收货人及租家提供的银行保函放货。
QUANTITY ON BS/L AS PER DRAFT SURVEY BY AN INDEPENDENT
SURVEYOR WITH COMPANY BY MASTR OR C/O. OWNRS NOT RESPONSOBLE FOR
SHORTAGE THEREOF AT DISCHG PORT.
提单上的货物数量根据独立测量员和船长的吃水测量结果或产地证. 船东不负责卸港因测量误
差导致的数量短少.
18. IF ANY DISPUTE/GENERAL AVERAGE FOR THE C/P,BOTH PARTIES WILL
KINDLY NEGOTIATE,IF THE NEGOTIATION FAIL,IT WILL BE SUBMITTED TO China
Maritime Arbitration Commission (CMAC)IN BEIJING AND CHINESE LAW TO BE
APPLICABLE.
若由本租船契约而发生争议, 双方应友好协商, 若协商不成, 应将争议提交到中国海事仲裁
委员会依据中国法律进行仲裁.
19. OTHER TERMS AND CONDITIONS AS PER GENCON CP 1994.
未尽事宜按金康标准合同94版。
